PRIVACY POLICY
LATV Networks, LLC (“LATV,” “we,” us” and “our”) understands that its customers, visitors, users, and others who use www.latination.tv (the "Site") (collectively or individually "Users") value their privacy. We are dedicated to safeguarding any personal information collected online and to helping Users learn how to exercise control over personal information while exploring the Internet. To this end, we ensure that our privacy policy and our information practices adhere to the U.S. Department of Commerce's Safe Harbor Principles. This privacy notice (the “Privacy Notice”) is incorporated into and is subject to the LATV Terms and Conditions. Please note that any video, image, or other content posted at the direction of Users onto the Site becomes published content and is not considered personally identifiable information subject to this Privacy Notice.

As we continue to offer our visitors new and different types of content and services, we may modify our practices from time to time. However, we will treat all personal information we collect in accordance with the Privacy Notice in effect at the time the information is collected. THE INFORMATION WE COLLECT
1. Types of Users.
(i) 12 years and younger. Protecting the privacy of young children is especially important. For that reason, LATV does not knowingly collect or maintain personally identifiable information or non-personally-identifiable information on the Site from persons under 13 years of age, and no part of our website is directed to persons under 13. If a User is under 13 years of age, then please do not use or access the Site at any time or in any manner. If LATV learns that personally identifiable information of persons under 13 years of age has been collected on the Site without verified parental consent, then LATV will take the appropriate steps to delete this information.
(ii) 13 years and older. We require Users 13 years and older to provide a first and last name, valid e-mail address, birth date, gender, and postal code. Although they have the option to voluntarily enter additional information (such as home address, state and country), it's not a requirement to activate their account.

2. User Provided Information. Users provide certain personally identifiable information (such as their name and email address) to LATV when choosing to participate in various activities on the Site such as uploading videos, posting messages in our forums or in the video comments section, entering contests or sweepstakes, taking advantage of promotions, responding to surveys, or subscribing to newsletters or other mailing lists. To protect Users’ privacy and security, we take reasonable steps (such as requesting a unique password) to verify Users’ identity before granting Users profile access or making corrections. Users are responsible for maintaining the secrecy of their unique password and account information at all times. 3. Changing User Info. Users can change their User information supplied upon registration (except for username, original e-mail address and date of birth) following the directions listed at www.latination.tv.

4. Computer Information. Computer information such as the type of computer operating system, the User's "IP Address", the web browser being used, and information regarding the Internet service provider may be collected.

(i) Cookies Information: When Users visit the Site, we may send one or more cookies (small text files that we and certain third parties place in visitors' computer browsers to store their preferences). LATV uses both session cookies and persistent cookies. A persistent cookie remains after Users close their browser. Cookies themselves do not contain any personally identifiable information, although they could enable us to relate a visitor's use of the Site to personal information that a visitor has provided, such as an e-mail address, we do not use them for this purpose. We do use "cookies" to determine how many visitors we have and how often they visit various sections of our site. Users can reset their web browser to refuse all cookies or to indicate when a cookie is being sent. However, some features of the Site may not function properly if the ability to accept cookies is disabled. Although we may track the numbers of visitors to inform us on how best to update the Site and enhance the experience for all visitors, Personal Information is not extracted in this process. We use tracking information on an aggregated basis to help us operate the Site, enhance and improve our service, improve the look of the Site and display advertising and marketing information. This Site may contain advertisements, references and links to other websites and organizations. We may also use third parties to display or serve advertising on the Site and our web-based newsletters. Often these third party Advertisers employ cookie and web bug technologies to measure advertising effectiveness. Users should be aware that different rules might apply to the collection, use or disclosure of their information by third parties in connection with their advertisements, promotions and other websites Users encounter on the Internet. The use of such technology by these third parties is within their control and not ours. Even if we have a relationship with the third party, we do not control those sites or their policies and practices regarding User information. This Privacy Policy does not cover any use of Personal Information or Sensitive Personal Information that a third party Advertiser or ad server may collect from Users. We encourage Users to investigate and ask questions directly of them in this regard.
(ii) Log File Information: When Users use the Site, our servers automatically record certain information that their web browser sends whenever Users visit any website. These server logs may include information such as Users’ web request, Internet Protocol ("IP") address, browser type, browser language, referring / exit pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the date and time of User requests, and one or more cookies that may uniquely identify their browser.

HOW THE INFORMATION IS USED
1. LATV internal purposes: to operate, maintain, and provide to Users the features and functionality of the Site, including, but not limited to, enabling visitors to enter one of our online contests or giveaways, to subscribe to our online newsletter or to inform Users of upcoming events and special announcements. We sometimes use the non-personally identifiable information that we collect to improve the design and content of our site, to personalize our visitors' experience on LATV.com, and to offer products, programs, and services. We also may use this information, in the aggregate, to analyze site usage, as well as to offer products, programs, or services. We use the email addresses of parents to notify them when we have received information from their children and to give them the opportunity to have their child's name removed from our lists. Also, we use visitor's personal information to track usage and to ensure Users are following the Site Terms and Conditions. Sometimes we will use agents or contractors to help us provide services to our visitors, such as helping us conduct a giveaway and contest, and sending prizes to the winners. In these cases, we require the agent or contractor to keep the information confidential and to use it only for the specific services they are performing. In addition, please review the section on “Collection of Information” by third party websites and sponsors for a description of the limited instance whereby personal information collected on the site may be supplied to third parties with the consent of the User.

We use both Users’ personally identifiable information and certain non-personally-identifiable information (such as anonymous User usage data, cookies, IP addresses, browser type, click stream data, etc.) to improve the quality and design of the Site and to create new features, promotions, functionality, and services by storing, tracking, and analyzing User preferences and trends.

We use cookies and log file information to: (a) remember information so that Users will not have to re-enter it during their visit or the next time Users visit the Site; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors, pages viewed, etc.; and (e) track User entries, submissions, and status in promotions, sweepstakes, and contests.

5. Information Voluntarily Disclosed Online (on discussion boards, in messages and chat areas, within Users’ public profile page, etc.). This personal information becomes publicly available and can be collected and used by others. User account names (not their email address) are displayed to other Users when they upload videos or send messages through the Site and other Users can contact Users through messages and comments. Any videos that Users submit to the Site may be redistributed through the internet and other media channels, and may be viewed by the general public.

6. Information Maintained when required to do so by law. Examples of such information are in response to a court order or a subpoena. We also may disclose such information in response to a law enforcement agency's or other public agency's (including schools or children services) request or if we feel that such disclosure may prevent the instigation of a crime.

7. We do not use Users’ email address or other personally identifiable information to send commercial or marketing messages without their consent or except as part of a specific program or feature for which Users will have the ability to opt-in or opt-out. We may, however, use their email address without further consent for non-marketing or administrative purposes (such as notifying Users of major Site changes or for customer service purposes). We will not use or transfer personally identifiable information in ways that are materially different from the ones described above without also providing parental notification of such practices and obtaining consent for any materially different uses.

COLLECTION OF INFORMATION BY THIRD PARTY SITES AND SPONSORS
Our Site contains links to other sites, including those of sponsors, advertisers and survey companies, whose information practices may be different from ours. These third party ad servers or ad networks use technology to send, directly to Users’ browser, the advertisements and links that appear on the Site. They automatically receive Users’ IP address when this happens. They may also use other technologies (such as cookies, JavaScript, or Web Beacons) to measure the effectiveness of their advertisements and to personalize the advertising content Users see. The use of these technologies by such third parties is subject to their own privacy policies, not ours. Visitors who do not wish their activities to be subject to this data collection should consult the websites of these third parties for their procedures for opting out of cookie placement.
LATV does not provide any personally identifiable information to these third party ad servers or ad networks without Users’ consent or except as part of a specific program or feature for which Users will have the ability to “opt-in” (click on a box to receive a third party's information) or “opt-out” (uncheck a checked box that will provide a sponsor with their information). However, please note that if an advertiser asks LATV to show an advertisement to a certain audience (for example, men ages 18-34) or audience segment (for example, men ages 18-24 who have viewed certain channels of content) and Users respond to that advertisement, the advertiser or ad-server may conclude that Users fit the description of the audience they are trying to reach. The advertiser may also use information regarding Users’ use of the Site, such as the number of times Users viewed an ad (but not any personally identifiable information), to determine which ads to deliver to Users.

SECURITY
We have put in place appropriate physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect on-line. Any breach of security (or Users’ desire to withdraw their consent from receiving electronic notice) Users should notify us via email at privacy@latv.com.
The Site is hosted in the United States and is intended for and directed to Users in the United States. If Users are accessing the Site from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through their continued use of the Site, which are governed by U.S. law, this Privacy Notice, and our Terms and Conditions, Users are transferring their personal information to the United States and their consent to that transfer.

ASSIGNMENT & TRANSFERABILITY
In the event that LATV is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from our Users as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how Users’ personal information is treated, transferred, or used.
